Hereinafter referred to as "Fintorpax", "we", "us" or "our".

By accessing, browsing or purchasing through this Website, you ("the User", "you") accept these Terms of Service in full. If you do not agree with them, please do not use the Website.

2. PURPOSE OF THE WEBSITE

The Website offers downloadable digital products (ebooks and playbooks in PDF format with accompanying templates, scripts, spreadsheets and AI prompts) designed for owners and managers of commercial service companies, including commercial cleaning, janitorial, grounds and landscape maintenance, pest control, window and facade cleaning and facility services. The products cover business-to-business prospecting, proposals and tenders, contract retention and account growth.

Fintorpax may add, modify, suspend or remove any product, content, price or functionality of the Website at any time and without prior notice.

3. ACCESS AND USE CONDITIONS

Access to the Website is free. Purchasing products requires the User to be at least 18 years old and to have legal capacity to enter into contracts.

The User agrees to use the Website and its contents in a lawful manner and, in particular, agrees not to:

- Use the Website for fraudulent purposes or in a way that could damage Fintorpax, other users or third parties.
- Infringe the intellectual or industrial property rights of Fintorpax or third parties.
- Attempt to access restricted areas, systems, servers or databases of the Website or its providers.
- Introduce viruses, malicious code or any element that may alter the Website's operation.
- Use automated tools to extract, copy or scrape Website content.

Any breach of these conditions may result in suspension of access, cancellation of orders or permanent blocking of the User, without prejudice to any legal action Fintorpax may take.

4. PURCHASE PROCESS

To purchase a product the User must:

1. Select the product and add it to the cart.
2. Provide accurate, complete and up-to-date information (name, email address and billing details).
3. Read and accept these Terms of Service, the Privacy Policy and the Refund Policy.
4. Complete payment through one of the available payment methods.

Once payment is confirmed, the User will receive an order confirmation email and a second email with the download link for the digital product. The User is responsible for providing a valid email address and for checking spam or promotions folders.

Fintorpax reserves the right to refuse or cancel an order in cases of suspected fraud, payment error, pricing error or breach of these Terms. If a cancelled order has already been paid, the amount will be refunded in full.

5. PRICES AND PAYMENTS

All prices are shown in US dollars (USD) unless otherwise stated. Prices may change at any time without prior notice, but changes will not affect orders already confirmed.

Prices do not include taxes that may be applicable according to the User's country or state of residence. Where applicable, taxes will be calculated and displayed at checkout before the payment is completed.

Payments are processed through secure third-party payment platforms (such as Shopify Payments, Stripe or PayPal). Fintorpax does not store or have access to the User's full card or banking details. The payment provider's own terms and conditions apply to the processing of each transaction.

6. DIGITAL PRODUCTS (EBOOKS AND PLAYBOOKS)

All products sold on the Website are digital products delivered electronically. No physical product is shipped.

Delivery is immediate: once payment is confirmed, the download link is sent to the email address provided and is also available in the User's account on the Website.

By completing the purchase, the User expressly consents to the immediate delivery of the digital content and acknowledges that, in doing so, they lose the right of withdrawal or cancellation that may otherwise apply to distance contracts, in accordance with applicable consumer protection laws (including, where relevant, the UK Consumer Contracts Regulations 2013 and Directive 2011/83/EU). For this reason, no returns or refunds are offered on digital products once they have been delivered, except where required by law or in the specific cases described in our Refund Policy (for example, a corrupted file or a duplicate order).

The products are licensed for the personal and internal business use of the purchaser. Each purchase grants a single, non-exclusive, non-transferable licence to one individual or one business entity.

7. TEMPLATES, SCRIPTS AND AI PROMPTS

The templates, scripts, spreadsheets and AI prompts included with the products are provided as working tools for the User's own business. The User may adapt and use them in their own commercial activity (for example, sending a proposal based on a template to their own client). The User may not resell, redistribute, publish or share these materials, in original or adapted form, as standalone products or as part of any course, service or digital product of their own.

Results obtained from AI prompts depend on the AI tool used by the User and are not controlled by Fintorpax. The User is responsible for reviewing any AI-generated output before using it.

8. INTELLECTUAL PROPERTY

All content on the Website and in the products (texts, ebooks, templates, scripts, spreadsheets, prompts, designs, logos, images, graphics, source code and structure) is the exclusive property of Fintorpax LLC or its licensors and is protected by United States and international copyright and intellectual property laws.

It is strictly prohibited to copy, reproduce, distribute, publicly communicate, transform, resell, sublicense, share, upload to public or private repositories, or otherwise exploit the products or the Website content, in whole or in part, without the prior written authorisation of Fintorpax.

Purchasing a product does not transfer any intellectual property rights to the User, only the limited licence of use described in sections 6 and 7.

Fintorpax may use technical measures to identify copies and will pursue unauthorised distribution.

9. LIABILITY

The products contain business, sales and operational information of an educational and informational nature. They do not constitute legal, financial, tax, accounting, insurance, employment or health and safety advice. The User remains solely responsible for compliance with the licensing, insurance, employment, health and safety, procurement and data protection requirements applicable to their business, their clients and their jurisdiction.

Fintorpax does not guarantee any specific result, including but not limited to: number of walkthroughs or tenders obtained, contracts won, renewal rates, price increases accepted, revenue per account, profit margins or business growth. Any figures, examples or case studies shown on the Website or in the products are illustrative, depend on each business's own circumstances and should not be understood as a promise of results.

Fintorpax shall not be liable for:

- Business, pricing, hiring, contractual or commercial decisions taken by the User based on the products.
- Results of implementing, or failing to implement, the strategies described.
- Contracts, proposals or tenders submitted by the User to their own clients, or any dispute arising between the User and their clients.
- Direct or indirect financial losses, loss of profit, loss of clients or contracts, or loss of data.
- Service interruptions, errors or malfunctions of the Website or of third-party platforms (payment providers, email services, hosting).

To the maximum extent permitted by law, Fintorpax's total liability for any claim related to a product shall not exceed the amount paid by the User for that product.

10. DISCLAIMER OF WARRANTIES

The Website and the products are provided "as is" and "as available". Fintorpax does not guarantee that the Website will be free of errors, viruses or interruptions, nor that the products will meet the specific expectations or needs of each User. Fintorpax will make reasonable efforts to correct any technical error reported.

11. THIRD-PARTY LINKS

The Website and the products may contain links to third-party websites, tools or services (for example, software recommended in the playbooks). Fintorpax does not control and is not responsible for the content, availability, policies or practices of such third parties. Access to them is at the User's own risk.

12. MISUSE AND SANCTIONS

The following conduct is considered a serious breach of these Terms:

- Fraudulent use of payment methods.
- Unjustified chargebacks or payment disputes initiated after the product has been downloaded, without first contacting Fintorpax.
- Sharing, publishing or reselling the products or download links.
- Abuse of the Website's systems or attempts to gain unauthorised access.

In these cases Fintorpax may cancel access to the products, close the User's account, permanently block the User from future purchases, and take any legal action it deems appropriate, including claims for damages.

13. CHANGES TO THESE TERMS

Fintorpax may modify these Terms of Service at any time. Changes will take effect from the moment they are published on the Website. The version in force at the time of each purchase will apply to that purchase. We recommend reviewing this page periodically.

14. GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of the State of New Mexico, United States of America, without regard to its conflict of law provisions. Any dispute arising from these Terms or from the use of the Website shall be submitted to the competent courts of the State of New Mexico.

This shall not affect any mandatory consumer rights that apply to the User under the laws of their country of residence (including the United Kingdom and the European Union), which shall prevail where they cannot be waived.
